Terms & Conditions
TRIALS/WAITING LIST:
If your child has attended a FunnClubb session before, you have to book them in for the term. Do not book a trial for a kid that has already attended The FunnClubb.
- Do not book multiple trials for a kid
- If your child has never attended a FunnClubb class. do not sign them up to 2+ waiting lists.
- If for any reason, you're not able to attend your trial date, please send an email to, hello@thefunnclubb.co.uk to have your trial date moved to the next week.
- After your childs trial, you'll receive an email in less than 24 hours, with a link to book your child into the remaining classes. Please make sure the email address you've provided is correct. Otherwise you won't receive an email and be able to book your child on.
1. DEFINITIONS
1.1 “Carer” means the person or persons who attends the course or part of it with the child.
1.2 “Parent” means a parent or legal guardian who will be responsible for the payment of fees and who is contracting party to this contract.
1.3 “The FunnClubb” means The FunnClubb LTD, with whom you have entered into this agreement.
1.4 “Course” means The FunnClubb course you are attending.
1.5 “Booking Form” means the form relating to booking or rebooking of the child on the course.
1.6 “Fee” means the monetary cost per course as specified on the booking form.
1.7 “Coach” means the individual(s), employed by The FunnClubb to teach the Course. Whilst every effort will be taken to maintain the consistency of the Coaches during the Course, The FunnClubb retain the right to change the coaching staff where necessary.
1.8 “Venues” or “Premises” means the premises where the course takes place.
1.9 “Pupil” means the child attending the course, whose details are specified by the Parent or carer on the booking form.
1.10 “Terms” means the terms and conditions set out in this document and any special terms and conditions agreed in writing by The FunnClubb and the parent.
2. ACCEPTANCE OF TERMS AND CONDITIONS
2.1 All agreements relating to the teaching of the course by The FunnClubb to the child are subject to these terms to the exclusion of all other terms and conditions.
2.2 No variation or addition to the terms shall be binding unless agreed in writing by The FunnClubb and the parent.
2.3 The terms shall be deemed to have been accepted by the parent upon payment of the fee by or on behalf of the Parent. Payment by the carer shall be deemed to have been made on behalf of the parent.
3. FEE AND PAYMENT/REFUNDS
3.1 The parent shall pay the course fee to The FunnClubb prior to the Pupil attending the course.
3.2 The fee is non-refundable under any circumstances except with the prior agreement of The FunnClubb, unless the Pupil has attended the first class of their course and given notice that they will not be continuing to attend classes within 24 hours of attending the first class, in which case the course fees will be refunded in full.
3.3 If classes are cancelled due to an “Act of God” (extreme weather conditions, earthquakes etc) strikes, terrorist activity or where local authorities/public guidance suspend for health or other reasons, then no refunds will be given and it will not be permitted to defer classes. After the 1st cancelled session due to an "Act of God", any other cancelled class in the term due to this reason, will be refunded. However, 4.5% - 20p of the total amount of the refund will be minused from the fee you payed (card processing & Stripe fees).
3.4 If you cancel your class before the new term begins, you will receive refund for your term payments. However, 4.5% - 20p of the total amount will be minused from the fee you payed (card processing & Stripe fees).
3.5 If you miss a class, we do not offer refunds or makeup classes - In the case of long-term illness, we will ask for a doctors note and provide you with a pro-rata refund. However, 4.5% - 20p of the total amount will be minused from the fee you payed (card processing & Stripe fees).
4. CANCELLATION
4.1 The FunnClubb may cancel this contract at any time before the Pupil commences the course for any reason whatsoever. The FunnClubb shall not be liable for any loss or damage whatsoever arising from such cancellation.
4.2 In the event of cancellation by The FunnClubb prior to commencement of the course by the pupil, The FunnClubb will refund any fees for outstanding classes.
4.3 The Parent understands that sessions are to be used consecutively.
5. PARENTS RESPONSIBILITY
The Parent warrants and represents that:
5.1 The information set out in the registration and booking forms is correct (whether or not completed and/or signed by the parent) and that The FunnClubb will be notified of any change in such information immediately.
5.2 When attending the course neither the pupil nor the Parent/carer will be suffering from any illness, disease or anything similar thereto.
6. DISCIPLINE
6.1 In the event that The FunnClubb believes the pupil or carer’s behaviour is unacceptable. The FunnClubb shall be within their rights to exclude the pupil and carer (or either of them) and for a period of time deemed fit.
6.2 The standard of behaviour regarded as unacceptable will be determined by The FunnClubb
7.EXCLUSION OF LIABILITY.
- Except in the case of fraud and subject to clause 7 below, The FunnClubb, its coaches, servants, employees or agents accept no responsibility under any circumstances for any loss (consequential or otherwise), damage, expense or delay suffered or incurred by the Parent, the Pupil or any other party arising directly or indirectly or in any way connected with the attendance of the pupil at the course (or any part of it) or any other act or omission on the part of The FunnClubb or agents even if such act or omission is negligent.
7.2 The Parent agrees (for and on behalf of the Parent and the Pupil) that any claim by the Parent or the Pupil against The FunnClubb or any coach, employee or agent of The FunnClubb must be brought within 60 days of the event that gave rise to such claim made thereafter shall be time-barred.
7.3 The Parent acknowledges, warrants and undertakes (for and on behalf of the Parent and the Pupil) that the maximum aggregate liability of The FunnClubb to the Parent and/or Pupil under these terms shall not exceed the Fee.
7.4 All warranties and conditions whether implied by statute or otherwise are excluded from this contract provided that nothing in this contract shall restrict or exclude liability for death or personal injury caused by the negligence of The FunnClubb its coaches, servants, employees or agents or affects the statutory rights of the parent or pupil.
8. GENERAL
8.1 Any notices to be sent by either party to the other shall be sent by pre-paid recorded delivery or registered post or hand delivered to the address of the relevant party and shall be deemed to have been received by the addressee within 48 hours of posting if sent by post and immediately if hand delivered. The FunnClubb do not accept service of documents by email or fax.
8.2 The failure by either party to enforce at any time or for any period any one or more of the obligations arising under these Terms shall not be a waiver of them or of the right at any time subsequently to enforce all the obligations arising under these Terms.
8.3 These Terms constitute the entire agreement between the parties hereto and supersede all prior agreements and understandings between the parties. It is agreed that no statement, promise or inducement whether written or oral alleged to have been made by either party and which is no contained herein shall be binding or form part of this agreement.
8.4 This entire agreement shall be governed by English Law and shall fall under English jurisdiction.

9.1 Please ensure the details you've provided for your child is correct.
9.2 Please ensure your email and contact details are correct, if you need it changed please email hello@thefunnclubb.co.uk.
9.3 Regular updates will be sent via email. If you don't receive the emails you may have entered the wrong email address on Class4kids or the emails get lodged in your junk/spam. In the latter case, select an email you want to add the sender to the Safe Senders list from the Junk folder. Right click it, and then select Junk > Never Block Sender in the right-clicking menu
10.FEEDBACK AND COMPLAINTS
10.1 We take all feedback and complaints very seriously. If you wish to make a complaint, please make this in writing to hello@thefunnclubb.co.uk. Although you can speak to your child’s coach about any issues or concerns you have, if you wish to have your complaint addressed, it MUST be made in writing
10.2 We will look at your complaint and get back to you with an initial response within 7 days - We aim to fully resolve your complaint within 14 days. However, it may take longer depending on the issue you’ve raised. We take complaints on a case by case basis and will discuss specific timescales with you if we cannot resolve this within 14 days.
